Terms of Service

By accessing, installing, or using KON INFOTECH FZCO's studio web applications, mobile software, plugins, or APIs ("Software" or "Applicable Product"), you agree to be bound by these Terms of Service ("Agreement"). If you do not accept these terms, do not use or install the Software. You waive any rights to require non-electronic signatures or records, to the extent permitted by law.

You must be at least eighteen (18) years old to use our Software. By using the Software, you affirm that you are over 18. If you are not, do not use our Software.

We grant you a limited, personal, revocable, non-exclusive, non-assignable, and non-transferable right to use the Software as follows:

• Guest Users: If you register for a trial, you may use the Software for two weeks with limited features and non-commercial use only. Animations will include watermarks.
• Paying Users: If you purchase a subscription, you may use the Software according to your selected plan. Animations for Paying Users do not include watermarks.
• Plan Changes: You may change your plan through the Software or by contacting us. Changes are subject to applicable subscription fees.

• You may not remove, hide, or minimize synthetic marks or watermarks from Animations without our prior written approval.
• You may not use the Software for any unlawful, harmful, or unauthorized purpose.
• You must comply with any applicable distributor or platform usage rules.

• You must create an account to use certain features.
• You agree to provide accurate and complete information and to keep your account secure.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized use of your account.
• To delete your account, email it@koninfotech.ae.

Some features may require access to your location data. If you do not provide access, those features may be limited or unavailable. Location data is handled in accordance with our Privacy Policy.

• The Software and all related content, trademarks, and materials are owned by KON INFOTECH FZCO or its licensors.
• You may not copy, distribute, sell, or exploit the Software or its content without our written consent.
• Your Inputs, Outputs, User Submissions, and Animations are not considered "Software Content" for intellectual property purposes.

• You will only be charged for paid services if you agree to such charges.
• Subscription fees are set forth in the Price List and may be billed monthly or annually.
• Subscriptions automatically renew unless cancelled at least fifteen (15) days before the next billing period.
• Payments are processed via third-party providers. We are not responsible for their acts or omissions.
• Failure to pay may result in suspension of your account.

We strive for accuracy but do not guarantee that Software content, outputs, or animations are error-free or current. We may update content at any time without notice.

• Personal data is collected and used in accordance with our Privacy Policy.
• You are not legally required to provide personal data, but doing so is at your own discretion.
• Some personal data may be stored on your device; you are responsible for device security.

We respect intellectual property rights and respond to clear notices of alleged copyright infringement.

To report infringement, provide our Copyright Agent with:

• Your signature
• Description and location of the copyrighted work
• Your contact information
• A good faith statement and declaration of accuracy

Counter-notifications must include your signature, identification of removed material, a good faith statement, and your contact information. Misrepresentations may result in liability under applicable law.

• The Software and all outputs are provided "as is" and "as available."
• We make no warranties regarding merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee error-free operation, security, or uptime.
• Your use of the Software is at your sole risk.

• We are not liable for any special, indirect, incidental, punitive, or consequential damages, or for loss of data, revenue, or business.
• Our total liability is limited to the amount you paid for the Software in the twelve (12) months preceding your claim.

You agree to indemnify and hold KON INFOTECH FZCO and its affiliates harmless from any claims, damages, liabilities, or expenses arising from your use of the Software, your content, or your violation of these Terms or third-party rights.

We may modify these Terms at any time by notifying you within the Software or by email. Changes become effective ten (10) days after notice. Continued use of the Software constitutes acceptance of the revised Terms.

You agree to comply with all applicable export laws and regulations.

We may provide updates or upgrades to the Software at our discretion.

These Terms are governed by the laws of Dubai, United Arab Emirates. Any disputes will be resolved exclusively in the courts of Dubai.
